As of 2005, some $45 billion worth of medical care is not being paid by uninsured patients (Families USA, 2005). What this means is that those with insurance pick up the tab for the people who cannot pay in the form of higher premiums. Another rationale for implementing this scheme is to encourage uninsured patients to get the care that they need, when they need it. Prior to the California Sutter Health scheme, many individuals did not visit the doctor when it was necessary, for fear that they would be hit with high medical bills (Families USA, 2005). This is because there was a great deal of uncertainty going in how much a certain procedure or visit would cost. What California Sutter Health did was show the patient, up front, what the costs would be, and this greatly empowers patients. The reason why this empowers patients is that they can see how much they will pay for something in advance. Then, they could either decide to get the procedur e done, at that time, if they had the money for it, or they could decide to put the procedure off until they had the chance to save up the money that was needed. Therefore, everybody wins ââ¬â the patient is allowed to know, up front, how much a procedure might cost, which helps the patient, and the hospital itself does not find itself stuck with uncollectible bills that makes the cost of health care higher for everybody. Gap was founded in 1969 by a real estate developer who was in search of a well-organized and well-stocked jeans store. The store was named after the generation gap and originally sold Levis jeans. In 1974, they developed their own private clothing label and by 1991 began selling only their private label brand. Gap introduced its website in 1997. The following year, in 1998, Gaps stock increased 138.4%. In 2000, though, their stock fell 44 %. Supplier power is high. For example, suppliers can exert strong influences on the producing industry by selling raw materials for clothing manufacturing at a high price. While suppliers yield substantial power, the buyers role is weak because of fragmentation. Finally, barriers to entry include: economies of scale, high capital requirements for stores, raw materials, and production requirements, and strong brand equity due to consumer brand consciousness and loyalty. Also, transaction costs can be reduced: for every sale online, Gap does not have to maintain bricks-and-mortar stores, hire personnel, or bear shipping costs. While these costs may be minimal right now, as online sales grow, this may have a serious impact on Gaps bottom line. An additional benefit of Gaps online store is ease of searching for particular products. The apparel industry is constantly changing. Therefore, marketing strategies and diverse customer segments are also transforming. Gaps brand recognitionà value is high with over 2,079 stores nationwide, and additional 530 stores globally. It is a standard brand name for the midrange fashion conscious consumer. Because Gap is a well-established bricks and mortars company, their processes are efficient and dynamic. For example, Gap stores are on detailed schedules for store displays, inventories, and new product launches. Every store receives an identical binder that explicitly details the display and product placements. Front window displays are changed weekly. They restock shelves with new products every six weeks, keeping the retail ahead of imitators in the fast-paced fashion industry. Even if competitors are able to catch on to Gaps short turnaround, there is no way to avoid being behind the times. Gap, through their extensive market research and market persuasiveness, is so in tuned to their customer segments that they effectively set the trend. Gap has invested a lot of money to become one of the biggest trend-setting brands. Although the Gap has a successful position on the Web, there are definite strategies that can be implemented to improve their online business. Our proposed marketing eBusiness plan involves Customer Relationship Management, growth strategies, incentive offers online, improved web design, and increased market research. At this point in time, Gap is a product-focused company. Gap needs to capitalize on the available technology of the Internet and transform its marketing efforts to focus on the consumer. Therefore, the company should shift from a Product Management system to a Customer Relationship Management system. Customer Relationship Management allows a company to cater to the unique and evolving needs of the specific customer segments. Currently, the Gap does not have extensive customization available on its website. Gap needs to create more ways of catering to each individual consumer. A pyramid approach would be optimal for the Gap. Much like the Dell triangle, the Gap would segment consumers and provide the most customization for the top small percent of the pyramid. These are the repeat customers that have highest volume of purchases, which would be the best group to provide customization. We suggest that the Gap use the technology of the Internet to store information on each consumer and generate a unique site for the consumer every time that they log on. The site will greet the consumer by name upon log in and target the consumer for their preferences. For example, the Gap would keep a database of my buying patterns, such as the fact that I always look for sale items, and also note the size that Ià normally buy. The Gap would be able to establish more relationships with consumers increase their loyal consumer base by providing customization that makes the site unique to the individuals. As retailers know, growth does not come from loyal customers. The Gap needs to focus some of their marketing efforts on acquiring new customers. They could do so by developing alliances with portal-type sites such as eGreetings.com. There, consumers can be asked to buy a gift certificate to Gap.com (not redeemable in offline stores) to be sent along with the greeting card. Online alliances are preferable to online banner ads and random advertising because a relationship with established online services and etailers is the best way to get a Gap ad seen. The click-through rates for banner ads are not convincing enough for us to suggest that the Gap increase online banner advertising. In addition to advertising online with trading partners, the Gap should advertise offline for the online store. Every media produced offline, including displays in the offline store, should have the web site listed, thus pointing consumers to the online store. The Gap may also consider putting a terminal in the offline stores that has a small computer with Gap.com constantly running. Sales associates can point consumers in the offline store to the terminal if they need a different size, or if they want to ship an item to a friend. Offering incentives online can also increase the customer base, persuading loyal and new consumers to utilize the Internet site. For example, every fifth purchase online could merit a certain percentage off the final purchase price or even free shipping. Also, the Gap should consider offering some products and product lines online only (for example, Gap currently offers their maternity line only online). This can entice consumers into shopping online in addition to their offline stores. Overall, anything that causes consumers to venture into the online world to check out the new items on Gap.com would be good for the growth of the online customer base. Another marketing tactic is to alter the design of the website to meet the needs of the constantly evolving Gap consumer. Currently, Gap.com allows consumers to see the various styles of clothing with color choices shown toà the side, but consumers cannot change the color of the item in the picture (for example, consumers could click on different colors and patterns for the same shirt and the shirt changes accordingly). See exhibit 2. Most buyers want to see what a certain article of clothing would look like in different colors, which is an option that Gap.coms competitor, JCrew.com, offers. Gap.com could also allow consumers to put clothes together on a model and view 360 degrees of the outfit, thus persuading people to make virtual outfits. Other design changes to Gap.com could be an addition of a search engine. This gives consumers a quick way to find specific articles of clothing. Another added design feature for the quick shopper could be a page with price listings by clothing category, or the ability to see the price on the first page instead of making consumers go through multiple pages to find the price. A final marketing strategy in our proposed plan is for Gap.com to increase market research to understand consumer-buying habits. Are they price conscious? What do they value in design of the website? The Gap would benefit immensely if they were able to understand their consumers behavior in depth. Therefore, information could enhance the quality of customization, which will benefit the company. If the Gap makes longer strides to understand their customer base, they can capitalize on areas where they are strong and change areas of weakness. Our proposed marketing plan encompasses many benefits with a few costs. The plan satisfies consumers because increased customization will mean more attention to specific customer needs. The proposed Customer Relationship Management tactic will create more of a one-to-one marketing structure that will in turn benefit the consumer. One cost to this change in management style is the capital needed to set up customization online and also the changes that must be made in the structure of management within the company. Employees will have to get used to a restructuring, which can cause a short period of dissatisfaction or frustration. But, the company as a whole will benefit from the restructuring because it will increase retention rates. The online incentives and improved web page design will benefit the consumers directly by giving them good deals and creating an easy-to-use web site. Theà online incentives will benefit the company by increasing the loyal customer base and the improved web design may increase sales and retention. The trading partners with Gap will benefit by increasing traffic to their sites, and association with the Gap brand is positive for alliances. One of the most apparent and serious threats to Gap.com is the threat of cannibalization. If Gap.com becomes the standard, then their offline stores will be severely hurt. This is why Gap is facing a great deal of resistance within the organization. Store managers whose salaries and promotions depend on store sales will not want to promote or support Gap.com because that will steal from their revenues. Another issue is the technological needs to satisfy the in-depth customization and database requirements that are essential to our e-business plan. In order to take on this new strategy, Gap will have to make a large initial investment to improve their technological capabilities to accommodate the customization. Internet speed must also be taken into consideration. Only eight million out of 100 million Internet households have broadband. In ShakespearesThe Tragedy of Hamlet, Prince of Denmark, character Ophelia can be analyzed through a feminist lens to better understand her purpose in the play and Shakespeares views of women in society. Freudian critic, Jacques Lacan answers a very prominent question. What is the point of the character of Ophelia? Obviously she is essential, for she is linked forever, for centuries, to the figure of Hamlet.(Lacan) Ophelia is used as a character to develop Hamlet. Her motives seem dominated by the characters around her with whom she interacts with, until she is driven to madness. In a sense, Ophelia is a sympathetic and engaging pawn in the drama that is surrounded by powerful men; her father Polonius, her brother Laertes, and Hamlet. Her madness can be linked to the abandonment of these men; Laertes leaves, Polonius dies, and Hamlet abandons her, because she no longer has the authority of the male world. By developing Ophelia as a character that relies on other mens judgements, Shakespeare supports principles of feminism stating that women are oppressed by men in society. A critical reading of Act 3, Scene 1 uses the interaction between Hamlet and Ophelia to apply a feminist reading. In this scene, Hamlet has just given his To be, or not to be soliloquy when Ophelia enters to converse with Hamlet. (lines 113-115). The text serves as a reflection of the internal thoughts of Hamlet. Hamlet at the moment is dealing with a life crisis. The text shows how Hamlet has stereotyped all women as whores because he feels that his mother has forgotten about his father far too quickly. In the same scene, Hamlet f urther explains his thoughts of women as he remarks if thou wilt needs marry, marry a fool, for wise men know well enough what monsters you make of them. (lines 139-141). He is lashing at Ophelia by telling her that women are unfaithful and driven by lust. As Hamlet accuses Ophelia of being like all other women he has once again stereotyped women in society. As a whole, both of these examples have helped the reader to understand William Shakespeares views of women in society as dependent on men and weak because they are driven by desire. The basic principles of a feminist theory state that the relationship between men and women has almost always been unequal and oppressive. The extent of inequality and oppressiveness has varied through history. That know societies have been patriarchal. Patriarchy is a system in which males dominate females. That all major social institutions have been characterized by male dominance in aspects such as economy, political system and family. A feminist theory also explain that sex and gender are not the same thing because sex is a biological category while gender is a social condition. French feminist philosopher Simone de Beauvoir writes One is not born, but rather becomes, a woman. The belief of difference in sex and gender also means that, males and females are socialized to become masculine and feminine. These are social characteristics implied by society, not biological essences. Novelist Simone de Beauvoir wrote a founding document of modern feminism in 1949.The Second Sexchanged the lives of many women. The Second Sex is one of the earliest attempts to confront human history from a feminist perspective shown through the effort of Beauvoir to locate the source of imbalanced gender roles in society. Today, many regard this masterwork as not only as pillar of feminist thought but of twentieth-century philosophy in general. The thesis of The Second Sex is that men fundamentally oppress women by characterizing them, on every level, as the Other, defined exclusively in opposition to men. Beauvoir believes that man occupies the role of subject while the woman is left as the other. Man is essential and absolute while woman is inessential and incomplete. The distinction that is basis for many of Beauvoirs later arguments; he creates, acts, or invents while she waits for him to save her. De Beauvoir writes that it is natural for humans to understand opposition to oth ers, however, the process does not apply to sex because by defining a woman as other, man is denying her of humanity. In Book II of the chronicles of the Second Sex, she traces the development of a woman through stages of life which include her childhood, her youth, and her sexual initiation. By doing so she proves that women are not born feminine, but instead are shaped by external forces. In this book, De Beauvoir shows how females are conditioned to accept passivity and dependence in every stage of her life. Processes in society deprive women of equality and oppress her into the other. After being denied the possibility of independent work or fulfillment, the woman must accept a life of housework, childbearing, and sexual slavishness. Beauvoir then continues to analyze the roles of woman in adulthood. She states that woman performs three major functions; wife, mother, and entertainer. The Feminine Mystique, written by Betty Friedan is another feminist novel that is regarded as one of the most influential books of the 20th century. Friedan expressed her beliefs that women are victims of a false belief system that forces them to find identity and meaning in their lives through the role of a housewife and mother. Such a system terminates a womans possibility of developing their own identity and forces them to come to terms with the identity as a housewife and mother through her husband and children. Friedan stressed her belief that women would only be liberated if they were given the same economic opportunities as men. Like wise, resolutions to oppression of women in society have the same views on liberation of women. To achieve liberation women must acquire economic power, by providing women with such opportunities, this will provide access to other forms of power. Such power includes political, ideological, and power within a family. Affirming Ophelia an independent character is difficult because she seems to not have past. In opposition to Hamlet, his past is known through the death of his father, his childhood and education, and the reader is informed of the relationship between Hamlet and his old friends. Ophelia does not seem to have a past. Thus, making it difficult to develop her character as independent. Shakespeare keeps Ophelia as a mysterious character, only appearing in five of the plays scenes. The relationship between her and Hamlet is only knows through scarce flashbacks of Ophelia. Feminist critic Juliet Dusinberre notices that the reason for Ophelias lack of independence is a result of a repressive double standard inherited in our traditions. Her father, Polonius, allows his son to become independent by leaving for the university to pursue his wild oats. He does so in order for Laertes to learn from his errors and how to be true to himself. For, if he can be true to himself then he shall be true t o other men. However, his daughter must not rely on her own judgement. Instead, he advices her to think yourself a baby (I.III.line 105) Her brother, Laertes, advised best safety lies in fear (I.III.line 43). Laertes is stating that fear will keep his sister safe. Ophelias sense of right and wrong is based on other peoples judgement. Ophelia does not ever given the opportunity to develop her own independent conscious. Her dependance on the male world is shown through her statement, I do not know, my lord, what I should think. (I.III.line 104). In accordance with the thesis of Beauvoir, Ophelia is being characterized as the other, she is deprived of the opportunity to develop herself as an individual. Instead she is oppressed into an incomplete character who is manipulated by the ideal of the men in her life. Even her internal thoughts are controlled, she is taught what is acceptable to believe and how she should live her life. Laertes and Polonius are even in control of her emotions , deciding who she may fall in love with. In the end, Ophelias individuality is robbed from her simply because she is a woman and seen as naive. In accordance with Friedan, Ophelia is an example of a woman who has been manipulated by a false belief system because she is led to believe that her father and brother ultimately know what is best for her. In a sense, she is brainwashed by the opinions and advice of the men who manipulate her life. Ophelia has lost her desire to uncover her own identity and sadly, in the end driven insane. Ophelias insanity can be seen as the lack of liberation she received, she was unable to come to terms with her identity as a stereotypical maiden. Hamlets father is killed by his brother who takes his wife and kingdom. Hamlet is then responsible for the revenge of his fathers murder. One may ask why Shakespeare chose to give the role of a protagonist to a male instead of a female. In this case, why did Shakespeare use Hamlet to avenge the murder? Why wasnt Gertrude given that role? Feminist critics suggest that the oppression of even female characters was a result of the gender structure of Elizabethan times. Female characters, Opelia and Gertrude, were not as critical in the play. Instead, they were used as pawns to further develop the character of the males. In the case of Gertrude, she is the object for which Hamlet feels possessive of. The fact that she re-married her husbands father short of his death is one of the prominent reasons that Hamlets actions are seen as insane. Ophelia played a similar role, she developed Hamlet as a character that was slowly turning mad. Shakespeare is able to portray Ophelia as inessential because once Hamlet turns mad, she follows shortly. Leading the reader to believe that Ophelia is lost without male direction which she has been so dependent upon. An important critical question being asked through out is what will be the resolution of the play? The reader closely follows Hamlet who has the obligation to avenge his fathers death. The ghost of his father urges him to murder Claudius, an eye for an eye. Only by doing so will he be able to re-establish the peace that has turned to chaos. However, Hamlet knows that morally, murder is incorrect and cant seem to bring himself to do so. He tries to contemplate alternative decisions but instead begins to turn insane, realizing that there are no other alternatives. Shakespeare seems to use Hamlet to avenge death rather than Gertrude because as a male figure, he has more power and complexity than a female. Another critical question that can be asked is why is Hamlets insanity so significant? Ophelia is also turning mad but Shakespeare seems to focus on the issues of Hamlet rather than Ophelia. Through questions such as these, he reader can understand that a woman who was turning crazy wa s a lost cause, however, a man was a complex individual who could find resolution. These questions are a further example of oppression of women. The reader must be familiar with Shakespearean time in order to fully understand the meaning and interpret the text, in particular, the Elizabethan era (1558-1603). This era is often considered to be the golden age in English history. Being the height of the english renaissance, this era developed english poetry music, and literature. Most importantly, elizabethan theatre flourished. The role of women in society was relatively unconstrained. In contrast to different cultures, women enjoyed freedom. Feminist critics agree that history has been dominated by men, where woman have simply served as mirrors to superior men. Modern feminism explains that women in the past havent been better understood due to their lack of possession of an identity, other than the one that has been given to them by more dominant characters. Through a feminist perspective the reader understands that Ophelia was a tragic character with a lost identity that came about after male forces no longer determined her actions.

Prayer in Schools Recently the U.S. Supreme Court announced that it would not hear the appeals of a case banning the traditional dinner prayer before the meal at the Virginia Military Institute (VMI). The court decided not to hear this appeal mainly due to procedural rules regarding the retirement of the schoolââ¬â¢s former superintendent before the case, but two of the justices, Rehnquist and Scalia, felt that the case needed to be tried in order to make a determination regarding prayer in universities, especially those with military affiliation (Biskupic 3A). Unfortunately, they did not have the required number of justices to carry the case to the court, but those outside of the court system do not have such restrictions upon their decision regarding organized prayer in universities. They can make their own decisions on what to believe. One must change the general opinion of the people in order to find resolution of this issue so they in turn can prompt a revision to the Constitut ion. This may be the only true solution to clarify this problem and this revision will need the support of the public in order to succeed. Prayers and other religious elements in government will be the focus of this revision. Those who would act to ban these prayers have made the mistake of misinterpreting the original intent of the framers of the Constitution regarding the First Amendment, they have misunderstood what it means to rank among those who call themselves an adult American, and have failed to comprehend the complexities of military training. The Constitution fails to ban prayer in government run areas with conscientious Americans under the special circumstances involved with military affiliated educational institutions. The people in favor of the ban on organized prayer in colleges make the claim that the 1st Amendment makes it unconstitutional. In order to make this claim, one must analyze the text of the amendment and the history behind the original intent of the Constitutions framers. The text of the amendment contains the following concerning religion, ââ¬Å"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereofâ⬠¦Ã¢â¬ (Constitution). This amendment should rightfully be interpreted as meaning that Congress does not have the power to regulate the religious institutions or prevent anyone from practicing their own religion.

I will look into the current employment legislation that organizations are faced with in regards to recruitment, (HOC) adopts, considering how I can make appropriate recommendations to improve the process as a whole as well as keeping the process compliant with the legislation. Investigate personnel requirements and undertake a Job analysis for an identified post. The importance of recruiting the right caliber of people for an organization is essential for many reasons, decreasing staff turnover, organizational costs, morale in existing workforce and the overall added value to organizational strategy and goals.Whilst I was researching which potential vacancy to use as the basis for completing this assignment, I immediately thought of a vacancy within the HER department that would be described as business critical to the HOC, the position is HER Pensions Administrator. The Requirements of the HER Pensions Administrator The post is the only resource allocated to pensions administration in the HOC, with a responsibility for compliance with legislative requirements, HEMP regulations and for compliance with the requirements of the Pensions Regulator.It is a standalone post, tit day to day responsibility for the administration of the pension agreements for over 1500 members, as well as liaising with the local Government Pension Schemes which we have inherited. They are also responsible for providing first line support to the Secretary of the Trustees, including day to day management of scofflaws, investment arrangements and liaison with the Scheme Actuary and other professional advisors. The peashooter is responsible for processing HOC Scheme joiners and leavers and is first point of contact for scheme members in relation to all ensign enquiries.They are also responsible for ensuring that all Scheme benefits (normal, retirements, Ill health retirements, death in service and other early retirements) are calculated accurately and paid in a timely manner. Taking the fin dings from the Job analysis and the information gathered by the different techniques used, I concluded that the reasons above explain why this specific post is business critical to the organization and that the post holder requires specific technical skills and experience needed to fulfill the entirety of the Job successfully.To investigate exactly what this post entails and to complete my Job analysis, I exercised a few different techniques to obtain the information required; Interview ââ¬â I set up an informal interview with the post holder to capture a good background of the Jobs expectancies, who the main stakeholders/customers are and how stressful a job it is. This technique was the most helpful when putting together my Job Description and Personal Specification, as I was able to establish the main pinch points, as well as the most important requirements needed for this particular post.Observation ââ¬â I thought shadowing the post holder would be way of attaining the J ob from a practical aspect. The HOC are members of the ââ¬ËTwo Ticks' Positive about Disabled People Scheme, this is where a disabled person is guaranteed an interview if they meet the minimum criteria for the Job. Its main aim it to stop the recruiting managers/employers using disability as a disadvantage to potential candidates. In our p rocess we incorporate into the short- listing stage so that the recruiting managers are aware of which applicants have with a note at the bottom to advising or should I say reminding them of best practice.If they do meet the minim criteria and therefore invited to interview, we then ask the candidate if there are any reasonable adjustments we need to make to accommodate them at the interview stage so no one is disadvantaged in any way. For example, we ad a candidate who was dyslexic, met the essential criteria and invited for interview. As it was quite a high profile Job, they we required to attend an assessment day. In order to make it a fair assessment we made reasonable adjustments to give the candidate more time when reading and completing certain tasks.I do think that HOC as an employer adheres to the scheme and certainly takes it very seriously. Although, I would go a step further and suggest that we (HER) keep the copy of the highlighted form and send the recruiting manager a short-listing form without the disabled antedates highlighted (if any). That way there will be no way the recruiting manager can indirectly discriminate or think they have a duty to short-list the disabled candidates even if the criteria has not been met.Age Discrimination The Age Discrimination Act is there to protect people of all ages.
